History of Nursing Home Abuse at Fiesta Park Wellness & Rehabilitation

This facility is not flagged for abuse by Medicare, but recent health violations show a history of neglect that raises concerns that unreported abuse may occur.  

During an inspection that occurred November 12, 2021, investigators found the following examples of nursing home neglect at Fiesta Park Wellness & Rehabilitation when staff failed to do the following:

  1. Timely report an unwitnessed fall resulting in injury to the New Mexico Department of Health as required by law 
  2. Devise a plan of care for a patient who refused to eat the facility food after he found a bug in it, resulting in the patient only eating when his daughter brought meals to him  
  3. Ensure that patients received regular showers or bed baths in accordance with their needs and preferences 
  4. Perform regular weight and skin checks

Health Violations at Fiesta Park Wellness & Rehabilitation

Medicare performs nursing home health inspections annually but inspects more frequently when it finds numerous or severe deficiencies and when it receives complaints. Fiesta Park Wellness & Rehabilitation has been inspected 24 times during the period from 2012 to 2021 and underwent two complaint inspections in 2022.  

Medicare has fined Fiesta Park Wellness & Rehabilitation $250,171 in the past three years and discovered 27 violations in the last year alone. This significantly exceeds the national average of 8.4 violations and the state average of 15.5.  

Medicare performed the most recent inspection on August 1, 2022, in response to complaints. The surveyor found that the facility was not providing residents with reasonable food choices during meal times or sufficient snacks between meals and in the evenings. This can result in residents’ dietary needs not being met. 

Sugar-free snacks were not made available for diabetics, and residents told investigators they had sufficient choices and snacks before the new company took over. Investigators also observed nursing home staff consuming the limited supply of snacks intended for residents. 

During the previous complaint investigation, which occurred on June 30, 2022, investigators found the following deficiencies: 

  1. Failure to provide patients with medical records upon request 
  2. Failure to administer medication to a patient with severe chronic disorders as ordered by the doctor

Medicare has rated the overall quality of care at Fiesta Park Wellness & Rehabilitation as above average. However, it has identified areas of concern related to the care received by short-stay and long-term residents.

Short-Stay Quality of Care

Medicare’s rating of the quality of care short-stay residents receive at Fiesta Park Wellness & Rehabilitation is above average. However, Medicare found that the percentage of residents who improve their mobility is just 61 percent. This is significantly lower than the national average of 74.1 percent and the statewide average of 66.5 percent. 

Fiesta Park Wellness & Rehabilitation patients were also less likely to experience improvements in their ability to care for themselves compared to the national average. 

Long-Term Quality of Care

Medicare has given Fiesta Park Wellness and Rehabilitation a score of three stars, or average, for the quality of long-term care while identifying several areas of concern. 

Pressure Ulcers

Long-term residents at Fiesta Park Wellness & Rehabilitation are more likely than average to develop bedsores. Nationally, an average of 8.1 percent of nursing home residents develop bedsores. The state average is 8.3 percent. As many as 11.5 percent of Fiesta Park Wellness & Rehabilitation residents develop bedsores. 

There is no acceptable number of occurrences of bedsores. They are caused by a nursing home’s negligence in failing to reposition immobile residents, keep their skin dry, and perform regular skin checks. 

Excessive Catheter Use
