Lawyer for Negligence Cases at Alden Estates of Barrington

There are times when you have no other option but to trust in a nursing home to handle the specialized, around the clock medical and daily care needs of your loved one. All nursing homes advertise exceptional care, content residents, and clean, comfortable facilities. But you worry. How can you be sure they are really maintaining these high standards? What really happens behind closed doors, after visiting hours are over?

The unfortunate truth is that nursing home negligence and abuse is occurring all too often at facilities nationwide. It is estimated that up to 5 million elderly Americans experience negligent care or abuse while in the care of a nursing home, many going unreported due to the resident’s fear of repercussions from caregivers or a lack of ability to communicate that there is a problem. In many Illinois nursing homes, staffing numbers are low, and sometimes patients aren’t always receiving the care they deserve. Some facilities even have major health violations and citations that have resulted in fines.

At Levin & Perconti, we are constantly seeking to ensure that nursing home residents are treated with respect and dignity. We fight for families and their loved ones that are in the care of these poor performing and understaffed facilities to get them compensation for their suffering, loss of dignity, and even loss of life of a loved one. We are dedicated to uncovering and sharing the facts about these facilities and making certain that these facilities are held accountable for their failures in care. Alden Estates of Barrington is a 150-bed for-profit nursing home that focuses primarily on post-acute, short term rehabilitative health care. Alden’s advertising paints a picture of upscale facilities, offering “5 star” care, going beyond your standard nursing home. Their website boasts a “holistic approach to quality care, using innovative therapies designed to send patients home as quickly and safely as possible”.

Luxurious accommodations and indulgent amenities are intended to make Alden a wonderful an enjoyable place to call home while recuperating from a hospital stay or rehabilitating after a major injury. While it’s true that many Alden facilities are highly rated by Medicare.gov, and have very few care violations on record, there are a large handful of underperforming or understaffed locations. Alden Estates of Barrington has an “Average” rating, which is better than many, but care failures happen even at these “Average” facilities:

5/25/2018 Failure to report suspected abuse, neglect, or theft and report the results of the investigation to proper authorities in a timely manner. A resident was observed with a purplish discoloration on their forearm. The resident is confused and cannot communicate what happened. There was no report made. (Facilities are required to report injuries of unknown origin within 2 hours of noticing.)

5/25/2018 Failure to provide care and assistance to perform activities of daily living for any resident who is unable. A resident was observed with a yellow film coating their teeth and a foul mouth odor. The resident’s chart listed as dental care performed the day of the inspection, however the resident disagreed. When questioned, the CNA responded that she used a small sponge and some water, not a toothbrush or paste. She marked this as completed, and said she intended to return to properly brush later.

Another violation was listed in reference to the same resident regarding a lack of dental care, where the resident’s family member states that the facility tells her “They will look in to it”. The family member reports that in care meetings she asks about a dentist visit but is always told “we will look into it”. The resident has been in the care of the facility for two years and no visit has been made.

12/7/2017 Failure to provide safe, appropriate pain management for a resident who requires such services. Record review and observation found that pain medication was not administered to a resident in need of pain control for two days.

The medication should have been refilled before running out, but due to a lack of follow-up with the pharmacy, the refill was not received until far after it was needed, leaving the resident in pain (according to the resident, 9 out of 10 level pain) for two days.
