Massage Envy Failed To Report Sexual Assaults

A male massage therapist sexually assaulted at least three women at an Old Town spa facility in separate incidents last year. Personal injury firm Levin & Perconti represents two of the women, referred to in court filings as Jane Doe and Jane Doe #2.

  • On December 10, 2019, a male Massage Envy Spa Chicago therapist sexually assaulted Jane Doe #2, removing her towel to expose her body and touching her buttocks and genitalia. The incident was reported to a spa manager.

Spa managers did not report the incident to police and failed to follow the company’s zero-tolerance policy around sexual misconduct. The assailant, who has a past felony charge, was not disciplined or terminated and, in fact, continued working as a Massage Envy therapist. Instead, a spa manager offered Jane Doe #2 a gift card for a free massage, which she did not use.

  • On December 27, 2019, at approximately 6:00 pm, the same massage therapist assaulted another Massage Envy customer, who reported the incident to staff. At 6:30 pm, the therapist was allowed to continue seeing customers and sexually assaulted Jane Doe. The assailant exposed Jane Doe’s breasts and touched her buttocks and vagina without consent.

“This isn’t simply a matter of one employee doing something terrible,” said Levin & Perconti attorney Megan Shore, who is representing Jane Doe and Jane Doe #2. “Massage Envy could have protected its customers from an employee with a criminal record and a history of assault allegations, but instead of acting upon complaints about him, they chose to turn a blind eye and let the abuse continue.”

The pseudonyms reflect the order in which the women filed their complaints, not the order in which the assaults occurred.

Women Suffered Emotional Distress After Sexual Assaults

Massage Envy’s zero-tolerance policies date back to 2017 when a national wave of hundreds of lawsuits – including four in the Chicago area – brought attention to their lax employee screening and customer safety protocols. The chain still does not require franchisees to notify local law enforcement of abuse, misconduct, or assault complaints.
