How Do You Collaborate With Medical Experts to Prove Nursing Home Abuse Cases?

Any nursing home neglect or abuse case requires expert testimony—that’s sort of the law in Illinois and in most states. We have been representing nursing home residents and their families for so long that, quite frankly, we have an expertise similar to doctors and nurses when it comes to looking at a nursing home chart and figuring out what happened. Unfortunately, there’s repeating misconduct that occurs in nursing homes that results in injuries, which basically revolves around lack of staffing and resources. But we still have every nursing home case reviewed by a nurse, because they add a certain perspective to the case. In order to file a case in Illinois, you actually have to have a doctor certify that the case is meritorious. So in all cases, we have a doctor who does that. In addition, as the case goes on, we hire experts who will testify from a medical, nursing, CNA, or LPN point of view about what a reasonably careful person in that profession should have done, and what they didn’t do in our case, which resulted in the injury or death that our client suffered. So, every nursing home case requires a nurse, probably a doctor, and sometimes other experts.
