How Do You Determine Liability in Cases Involving Birth Injuries and Cerebral Palsy?

Video Transcript

Whether or not a doctor is liable or responsible for a little boy or little girl having cerebral palsy depends on a lot of things, and it comes back to did they act in a timely manner at or near the time of birth or at or near the time of delivery. What we have is the ability to talk to medical experts all over the country at highly regarded institutions that actually look at all of the patient’s medical records, both mom and baby, and all of the fetal heart rate strips, both mom and baby. We get answers from them as to whether or not the care was handled in an appropriate way, and when we get answers, we’re able to give the families answers.

We can’t help everybody all the time; there are times that we have to turn people down because we can’t get the support we need from the experts we need. But at the end of the day, we provide families with answers as to what happened to their child.
