What Evidence Strengthens a Birth Injury Case, and What Should Be Tracked?

There’s a lot of variation in the type of evidence that could be important in establishing a claim for a birth injury. You know, obviously we look at what is the injury and how it’s going to impact the young child. If we’re talking about, in terms of evidence regarding whether or not the doctors or the nurses did something wrong, there’s a lot of things that we look at. But I would sum it up like this: what information was available, who had the information, and what did they do with it?
For example, you know, a lot of times the fetal heart rate strips become an issue in these types of cases. Are we seeing repetitive decelerations? Are we seeing consistent heart rate below a certain number? Are we seeing a heart rate above a certain number? All of this type of information is really, really important for us to determine whether or not the doctors or nurses did something wrong.
