What Legal Options Do Families Have if a Child Is Diagnosed with Cerebral Palsy?
Video Transcript
Depends on what happened, but I would encourage people to call an attorney. The legal options may be that they have a valid claim for medical negligence, and that’s where we’re getting into what did the doctors know, what did the nurses know, and what did they do with that information. Did they act in a timely fashion? If you have a child, or you know someone who has a child that’s been diagnosed with cerebral palsy, it’s probably a good idea to at least talk to somebody, an attorney who can help you figure out whether or not something went wrong.
One of the things that is most devastating about cerebral palsy is on a family is the level of care that is needed to provide for that child throughout the course of their life. That’s something that can come from a lawsuit. That’s the goal is to try to do what’s necessary to take care of that little boy or girl from a medical perspective, but also, obviously, to compensate for all of the things that that child has lost out on. Those are the types of things that are compensable damages under Illinois law.
