What Steps Should Someone Take If They Suspect They Are a Victim of Medical Malpractice?

For victims of medical malpractice, it’s really, really important to call someone right away. The reason is you have a limited amount of time to bring a lawsuit in a medical malpractice case, especially if you’re an adult. The statute of limitations in a medical malpractice case is 2 years for adults. There are some narrow exceptions that could extend the statute of limitations, but in no cases is a medical malpractice case—you have to bring it within, at the very latest, four years. But usually, it’s 2 years from the time that you know or should have known that something went wrong. And why that’s so important is because it takes us time to gather the medical records; it takes us time to figure out what specialties we need to talk to. We have to talk to people not only about whether or not the doctor did something wrong, but we have to talk to them about whether or not the doctor’s mistakes actually caused an injury. You really, really have to act quickly. I’ve had to turn people down that have called just too late.
